Dukeminier, Property, Aspen, 7th. ISBN# 9780735588998.

Syllabus

First Assignment: For our first class on Monday, August 26, 2013, please prepare pages 1-18 of Property, 7th Edition, Dukeminier (AKA “The Duke”).

When preparing this case for class, be sure you have reviewed the materials carefully enough that you can recite the facts of the case, explain what decision was rendered and why, and discuss the notes and commentary found following the case.  In class, we will discuss the key components of any judicial decision: facts (including parties and procedural history if indicated), legal issue, holding, rule of law, and rationale.  In order to have some familiarity with these concepts, please be sure to review the case brief you were taught about during orientation.  You do not need to write a formal case brief for the first day of class, but you should do so if it helps you to prepare thoroughly.  Please also think about the case, whether you agree or disagree with the opinion, and why.

For Wednesday, August 28, please read pages 18-35 of The Duke.
